GDPR Consent Terms

These GDPR Consent Terms explain when and how we seek, record, and rely on consent as a lawful basis for processing personal data under the General Data Protection Regulation (GDPR). They complement our Privacy Policy and Cookie Policy.


1) Scope

These terms apply to processing activities where we rely on GDPR Article 6(1)(a) (consent) and, where relevant, Article 7 (conditions for consent) and Article 8 (children’s consent). For processing that is necessary to operate the service, fulfill a request you make, comply with law, or protect our legitimate interests, we rely on other lawful bases and do notseek consent.


We request your prior, freely given, specific, informed, and unambiguous consent before we start any processing that is not strictly necessary, including:

  • Analytics & measurement (non‑essential cookies/SDKs) — understanding usage and improving performance/features.
  • Personalization — tailoring content, search results, recommendations, and preferences beyond what is strictly necessary.
  • Marketing/advertising — newsletters, product updates, remarketing pixels, cross‑service tracking, and campaign measurement.
  • Precise location — using GPS/Wi‑Fi/Bluetooth for features you choose to enable.
  • Push notifications — opt‑in alerts for things like saved search updates (where supported).
  • Third‑party embeds — enabling maps, videos, or social plugins that set non‑essential identifiers.

For essential purposes (security, fraud prevention, error logging, load balancing, core session management, or delivering a request you initiate), consent is not required.


Depending on the purpose(s) you select, we may process:

  • Online identifiers (cookie IDs, ad IDs), device/browser metadata, truncated IP, interaction and event data.
  • Marketing preferences and engagement metrics (opens, clicks).
  • Approximate or precise geolocation (only if you enable it).
  • Inferences for personalization (e.g., likely interest in certain property types).
    We minimize and aggregate data where feasible.

  • First‑layer banner & link to Preferences Center on initial visit and whenever required.
  • Granular toggles per purpose. Non‑essential purposes are OFF by default.
  • Separate, unbundled choices (e.g., marketing email opt‑in is independent from sign‑up).
  • Affirmative action only — e.g., clicking “Accept all” or enabling a toggle. Pre‑ticked boxes, silence, or scrolling do not constitute consent.
  • No dark patterns — choices are presented clearly and symmetrically, with equal prominence for accept/reject.
  • Records of consent — we store a pseudonymous ID, purpose settings, timestamps, region signal, user agent, CMP/version shown, and the source of consent/withdrawal to demonstrate compliance.
  • Renewal — we will re‑prompt at reasonable intervals (e.g., every 12 months) or sooner if purposes/vendors change materially.
  • Proof of consent — upon verified request, we can provide a summary of the consent record associated with your device/account.

  • Preferences Center — accessible at any time via the site footer and account settings (if available).
  • Withdraw with one step — toggle a purpose OFF, select “Reject non‑essential”, or use the unsubscribe link in each marketing email.
  • Effect of withdrawal — processing based on consent will stop for the selected purposes going forward; past processing remains lawful. We will delete or de‑identify related identifiers where applicable.
  • Device/browser controls — you may delete identifiers or block them at the device or browser level (some functionality may be affected).

We do not knowingly process personal data from individuals below the digital consent age applicable under GDPR (which varies between 13 and 16). If you are below that age, a parent or legal guardian must provide consent. Please contact privacy@availablemax.com if you believe a minor has provided personal data.


We retain consent records and related identifiers only as long as necessary to evidence compliance and operate the selected purposes, typically no longer than 25 months for analytics identifiers, unless a shorter period is specified in the Preferences Center.


8) Vendors and third‑party technologies

Non‑essential third‑party technologies are blocked by default until you consent. The Preferences Center displays, for each vendor or purpose: name, description, data types, retention period, identifier categories, and available opt‑out links. We update this registry when partners or purposes change.


9) International data flows (summary)

Where data is transferred outside your region, we use appropriate contractual and technical safeguards as described in our Privacy Policy. Vendor activation remains subject to your consent for non‑essential purposes.

Annex E — Implementation checklist (internal)

  1. Deploy a Consent Management Platform (CMP) with purpose‑level toggles.
  2. Default non‑essential purposes to OFF; block tags until consent.
  3. Provide a persistent Privacy/Settings link in footer and account settings.
  4. Store consent logs securely with limited retention; perform regular audits.
  5. Maintain a vendor registry (name, purpose, data types, retention, identifier categories, opt‑outs).
  6. Ensure toggles actually control tags/events client‑ and server‑side.
  7. Re‑prompt for material changes or every 12 months.
  8. Test for accessibility (WCAG 2.1 AA), responsiveness, and localization.
