This Privacy Policy explains in clear and detailed terms the categories of personal information we collect, how we use it, how we may share it with others, the rights you have under U.S. laws, and the steps we take to protect it.
By using our websites, mobile applications, APIs, widgets, email or SMS programs, and all related services (collectively, the “Services”), you acknowledge that you have read, understood, and agreed to the practices described in this Privacy Policy. If you do not agree with this Policy, you should stop using the Services immediately.
1) Scope of This Privacy Policy

This Privacy Policy applies to all individuals and entities who access or interact with the AvailableMax Services in any capacity, including:
- Visitors who browse our website without registration.
- Consumers who create accounts to save searches, favorite properties, or request more information.

- Real estate professionals such as agents, brokers, and property managers who use our professional tools.
- Businesses or developers who integrate with our APIs or other tools we may provide.
Unless explicitly stated otherwise, the protections and obligations described in this Policy apply equally across these categories of users.
1.2 Coverage of online and offline activities
This Privacy Policy covers both online and offline interactions with AvailableMax. It applies when you:
- Use our website, mobile applications, or APIs.
- Communicate with us by email, SMS, in-app chat, or phone.
- Interact with our staff at events or through any other offline channel.
- Send us documents, letters, or other materials by mail or courier.
Any personal information collected through these online or offline channels is handled in accordance with this Privacy Policy.
1.3 Relationship to our Terms of Use
This Privacy Policy is incorporated into and forms part of our Terms of Use. The Terms of Use govern your contractual relationship with AvailableMax and the rules of using our Services. This Privacy Policy governs how we collect, use, and share your personal information. In the event of a conflict, the Terms of Use control with respect to service functionality and limitations of liability, while this Privacy Policy controls with respect to the handling of personal information.
1.4 U.S.–focused services
Our Services are operated primarily from the United States and are designed for users located in the U.S. Real estate content, legal references, and compliance obligations are based on U.S. federal law and applicable U.S. state laws. If you access the Services from outside the United States, you do so on your own initiative, and you are responsible for ensuring that your use of the Services complies with the laws of your jurisdiction. Your information will be processed in, and subject to, U.S. law.
2) Categories of Information We Collect
We collect personal information to deliver, operate, secure, and improve the Services. We collect information in three main ways:
- Information you provide directly.
- Information collected automatically when you use the Services.
- Information we receive from third parties.
2.1 Information you provide directly
Examples of information you provide directly include:
- Account registration details. Name, email address, phone number, password, and optional profile details (such as a profile photo or indication that you are a buyer, renter, owner, or licensed professional).
- Professional verification. Real estate professionals may provide license numbers, brokerage details, professional affiliations, or proof of access to MLS/IDX data. We use this to verify eligibility and comply with state licensing and MLS rules.
- Property listing information. Property owners, landlords, and professionals may upload property details such as addresses, geographic coordinates, square footage, features, descriptions, disclosures, photos, videos, floor plans, and 3D tours. Listing information may also include occupancy status or contact information for the owner or representative.
- Payment and billing information. If you purchase advertising, subscriptions, or other paid Services, we may collect billing addresses and payment details such as credit/debit card numbers or bank account information. These are processed in compliance with the Payment Card Industry Data Security Standard (PCI DSS) through trusted payment processors.
- Tenant applications and screening data. If you submit a rental application through the Services, you may provide employment history, rental history, references, income verification, government identification, and Social Security numbers. This information may be shared with consumer reporting agencies for screening purposes, subject to the Fair Credit Reporting Act (FCRA) and applicable state laws.
- Communications and support. We may collect the content of messages you send or receive through the Services, including emails, in-app messages, SMS text messages, and phone calls made or routed via our systems, along with related metadata (such as date, time, and participants).
2.2 Information collected automatically
When you use the Services, certain technical and usage data is collected automatically. This helps us ensure security, reliability, and a personalized experience. Examples include:
- Device and network information. IP address, browser type and version, operating system, device model, mobile carrier, and similar technical identifiers.
- Usage data. Pages viewed, property searches performed, filters used, time spent on listings, links clicked, referring URLs, error logs, and crash reports.
- Location data. We may infer approximate location from your IP address, and if you enable location services on your mobile device, we may collect more precise GPS-based location to show nearby listings and local information.
- Cookies and similar technologies. We use cookies, pixels, tags, SDKs, and local storage to recognize your device, maintain sessions, remember preferences, secure the Services, analyze traffic, and support advertising.
2.3 Information from third parties
We may receive information about you or your activity from third parties, including:
- Multiple Listing Services (MLS) and brokers. Licensed feeds and broker data provide listing information, attribution, and other property-related details.
- Consumer reporting agencies and credit bureaus. When you authorize tenant screening, we may receive credit reports, background checks, or eviction history data, subject to FCRA and state law.
- Payment processors. We may receive confirmations of successful or failed transactions, fraud-prevention signals, and chargeback alerts.
- Public records and data providers. Property deeds, tax records, zoning information, and other publicly available real estate or demographic data.
- Third-party integrations and social sign-in. If you choose to connect or authenticate using a third party (for example, Google or Apple), we may receive basic profile information as allowed by your settings with that provider.
3) How We Use Information
We use personal information to deliver, operate, secure, and improve the Services, to communicate with you, to comply with U.S. legal obligations, and to protect the rights and safety of users and AvailableMax.
3.1 Providing and operating the Services
- Create and manage user accounts and profiles.
- Display property listings, search results, and related content.
- Facilitate communication between buyers, renters, sellers, landlords, and professionals.
- Process payments and manage subscriptions or advertising campaigns.
3.2 Verification, safety, and fraud prevention
- Verify the identity and professional status of agents, brokers, and property managers.
- Detect and prevent fraud, spam, abuse, and unauthorized access to accounts.
- Protect users from scams, misleading listings, or other harmful activities.
3.3 Personalization and analytics
- Recommend properties based on your searches, favorites, and viewing history.
- Customize content, features, and offers to your preferences.
- Analyze how users interact with the Services to improve performance, design, and usability.
3.4 Marketing, advertising, and communications
- Send you emails or SMS messages about new features, listings, promotions, or market insights, where permitted by law and subject to your communication preferences.
- Deliver and measure advertising (including targeted ads) on our Services and on third-party platforms, in accordance with U.S. laws such as the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA).
- Send important transactional messages such as account alerts, security notifications, or messages about changes to our Terms or this Policy.
3.5 Legal compliance and enforcement
- Comply with United States federal and state laws governing real estate, consumer protection, privacy, credit reporting, and electronic communications.
- Respond to lawful requests from courts, law enforcement, regulators, or other authorities.
- Enforce our Terms of Use, policies, and agreements, and protect our rights, property, and safety, as well as those of our users and the public.
4) How We Share Information
We do not sell your personal information in the traditional sense of selling customer lists for money. However, we do share personal information with certain third parties as described below in order to provide and improve the Services, comply with the law, and support advertising and analytics.
4.1 Real estate professionals and property owners
When you request information about a property, schedule a tour, or submit an inquiry or rental application, we may share your contact details and message content with the listing agent, broker, landlord, property manager, or their authorized representative so they can respond to your inquiry.
4.2 Service providers and vendors
We engage third-party companies to perform services on our behalf, such as:
- Cloud hosting and data storage.
- Payment processing and billing.
- Email and SMS delivery.
- Analytics, error tracking, and performance monitoring.
- Customer support tools and CRM platforms.
These service providers are authorized to use your information only as necessary to provide services to AvailableMax and are contractually required to protect your information and comply with applicable U.S. laws.
4.3 MLSs, licensors, and compliance partners
Because we display data licensed from Multiple Listing Services and other real estate data providers, we may share certain usage data, logs, or reports with them to comply with our license agreements and audit requirements.
4.4 Tenant screening and consumer reporting agencies
If you submit a rental application and authorize tenant screening, we will share your application data with consumer reporting agencies or background-check providers to obtain reports as allowed under the Fair Credit Reporting Act (FCRA) and similar state laws. We do so only with your consent and only for screening purposes.
4.5 Legal, regulatory, and safety-related disclosures
We may disclose information if we believe, in good faith, that it is reasonably necessary to:
- Comply with a subpoena, court order, or other legal process.
- Cooperate with law enforcement or regulatory authorities.
- Protect the rights, property, or safety of AvailableMax, our users, or the public.
- Investigate and defend against legal claims or allegations.
4.6 Business transfers
If AvailableMax is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of our assets, your information may be transferred as part of that transaction. If such a transfer occurs, we will take reasonable steps to ensure that the recipient honors this Privacy Policy or provides a comparable level of protection, and we will notify you of any material changes.
4.7 Advertising and analytics partners
We may share limited information with advertising networks, social media platforms, and analytics providers to deliver and measure ads, and to understand how users interact with our Services. Under certain U.S. state privacy laws (for example, California), this type of sharing may be considered a “sale” or “sharing” of personal information for targeted advertising. You may have the right to opt out of such activities, as described in Section 7.
4.8 Aggregated and de-identified information
We may share aggregated or de-identified information that cannot reasonably be used to identify an individual. For example, we might publish statistics about search trends in a particular city. When we de-identify data, we take steps to reduce the risk that it can be re-associated with a specific person.
5) Cookies & Tracking Technologies
AvailableMax uses cookies and similar technologies to make the Services work, to remember your preferences, to enhance security, to analyze usage, and to support advertising. This section explains how those technologies operate and what choices you have.
5.1 Types of technologies we use
- Cookies: Small text files stored in your browser.
- Pixels and web beacons: Small images or snippets of code used to track when a page or email is viewed.
- SDKs: Code built into mobile apps to measure usage and performance.
- Local storage: Data stored locally in your browser or device for faster access.

6) Data Retention
AvailableMax retains personal information only for as long as reasonably necessary to provide the Services, meet legal and regulatory obligations in the United States, protect our rights, and resolve disputes. Because different types of information serve different purposes and are subject to different legal requirements, retention periods may vary.
6.1 General principles
- We retain information only as long as needed for our business and legal purposes.
- When data is no longer required, we seek to delete it, anonymize it, or store it in an archived form with restricted access.
6.2 Examples of typical retention periods
- Account and profile data: While your account is active and for a period after closure, typically up to 2 years, unless a longer period is required for legal or security reasons.
- Property listings and media: For as long as the listing is active, plus an additional period (often 1–7 years) for audit, compliance, and dispute resolution, depending on MLS and contractual obligations.
- Payment and billing records: At least 7 years, in line with U.S. tax and accounting requirements.
- Tenant screening data: Typically several years (for example, up to 5 years) to comply with FCRA and state housing laws and to respond to disputes.
- Communications and support records: Usually retained for 2–5 years, depending on the nature of the correspondence and any legal risks.
- Security logs and technical data: Often retained for 12–24 months, unless an investigation or legal matter requires longer retention.
7) Your Privacy Rights
AvailableMax is committed to respecting your privacy rights under U.S. federal and state law. The rights you have may depend on where you live and how you use the Services, but we strive to honor reasonable requests from all users.
7.1 Federal U.S. protections
- CAN-SPAM: You have the right to opt out of marketing emails. Every marketing email we send includes an unsubscribe link.
- TCPA: We obtain your prior express consent for promotional text messages or automated calls where required. You may revoke consent at any time (for example, by replying “STOP”).
- FCRA (for tenant screening): If a landlord takes adverse action based on a consumer report (such as denying a rental application), you have the right to receive an adverse action notice and to dispute inaccurate information with the consumer reporting agency.
- COPPA (children’s privacy): We do not knowingly collect personal information from children under 13, as further described in Section 8.
7.2 State privacy laws (e.g., California, Colorado, Virginia)
Several U.S. states provide additional privacy rights to their residents. Depending on your state of residence, you may have rights such as:

8) Children’s Privacy
The Services are intended for use by adults and are not directed to children. Real estate-related services typically involve financial and legal obligations that require users to be of legal age.
- You must be at least 18 years old to create an account or use our Services in your own name. If you are under 18, you may only use the Services with the direct involvement of a parent, legal guardian, or licensed real estate professional.
- We do not knowingly collect personal information from children under 13. If we learn that a child under 13 has provided us with personal information, we will promptly delete it and, if appropriate, notify a parent or guardian.
9) Security
AvailableMax employs administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. While no online system can be guaranteed 100% secure, we work to mitigate risks consistent with industry standards and U.S. regulatory expectations.
9.1 Examples of safeguards

- Use of reputable, security-certified hosting providers and data centers.
- Access controls, including role-based access and authentication safeguards.

9.2 Your responsibilities
- Use a strong, unique password for your AvailableMax account.
- Do not share your login credentials with others.
- Be cautious of phishing attempts or suspicious messages claiming to be from AvailableMax.

10) Data Storage & U.S. Processing
AvailableMax is based in the United States, and our primary data processing and storage activities occur in the U.S. By using the Services, you understand that your information will be stored and processed in the United States and will be subject to U.S. laws.
If you access the Services from outside the United States, you do so at your own risk and are responsible for complying with any local laws that may apply. To the extent permitted by law, your continued use of the Services constitutes your consent to the transfer, storage, and processing of your information in the U.S.
11) Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our business practices, technology, or applicable law in the United States. When we make changes, we will revise the “Effective Date” at the top of the Policy and, where appropriate, provide additional notice (such as by email or in-product banners).
In some cases, we may ask for your consent before implementing certain changes, where required by law. Your continued use of the Services after an updated Privacy Policy has been posted indicates that you have read and understood the changes.
