(“AvailableMax,” “we,” “us,” or “our”) collects, uses, discloses, stores, protects, and otherwise processes personal information when people use our websites, dashboards, mobile experiences, listing tools, valuation tools, contract and document workflows, APIs, communications features, subscriptions, advertising products, and related services.
By using AvailableMax, creating an account, submitting information, communicating through the platform, using our mobile or dashboard tools, purchasing a plan, or continuing to use the services after an update, you acknowledge that you have read this Privacy Policy. This Privacy Policy is a notice about data practices. Our Terms of Use separately govern use of the services.
1. Scope and Users Covered
This Privacy Policy applies to personal information we process through AvailableMax services, including availablemax.com, related subdomains, dashboards, mobile app experiences, APIs, embedded tools, email and SMS programs, support channels, valuation tools, professional profiles, property listings, contract workflows, lead tools, and subscription or billing features.
This Policy applies to visitors, registered users, consumers, subscribers, agents, agencies, brokerages, developers, builders, landlords, property managers, property owners, vendors, advertisers, professional applicants, contract participants, guests, counterparties, dashboard users, mobile app users, API users, CRM contacts, leads, and other people who interact with AvailableMax.
This Policy does not apply to third-party websites, apps, payment pages, MLS systems, social platforms, or services that are not controlled by AvailableMax, even if they link to or integrate with our services. Those third parties are responsible for their own privacy practices.
2. Information We Collect
The information we collect depends on how you use AvailableMax, your account role, the services enabled for you, and the information you choose to provide.
2.1 Account, profile, and contact information
- Name, email address, phone number, username, password credentials, profile photo, account role, preferred language, company or organization details, and communication preferences.
- Account status, plan type, package details, membership history, subscription status, approval status, verification status, and related account administration records.
2.2 Professional, agency, developer, and business information
- Real estate role, license or credential details, brokerage or agency information, professional biography, service areas, specialties, team details, business address, website links, social links, logos, documents, and application materials.
- Information used to evaluate, approve, classify, verify, publish, suspend, or manage professional, agency, developer, advertiser, partner, or business accounts.
2.3 Property, listing, and real estate content
- Property addresses, city, state, area, coordinates, listing descriptions, price, availability, square footage, property facts, amenities, disclosures, media, documents, floor plans, project details, ownership or representative information, and related listing metadata.
- Information from MLS, IDX, public records, data providers, user submissions, professionals, agencies, developers, owners, landlords, and property managers.
2.4 Search, favorites, saved searches, and activity information
- Search terms, filters, viewed listings, favorites, saved searches, inquiry history, pages viewed, links clicked, device sessions, feature usage, and related analytics.
- Approximate location derived from IP address and, if you permit it through your device or browser, more precise location information used for nearby listings or local features.
2.5 Leads, CRM records, communications, and support
- Lead forms, inquiry messages, names, emails, phone numbers, property interests, source information, timestamps, support requests, feedback, notes, call or message metadata, and communications between users and AvailableMax or between users through AvailableMax tools.
- CRM contact details, assigned team members, lead status, follow-up notes, routing history, and business workflow records created by professional or organization users.
2.6 Contracts, documents, identity, and signature information
- Contract records, document drafts, forms, attachments, counterparty names, emails, phone numbers, reviewer details, signing status, signature records, timestamps, IP addresses, verification codes, guest access records, delivery records, and audit trail information.
- Identity documents, returned attachments, approvals, rejections, comments, and workflow records when a contract, document, verification, or business process requires them.
2.7 Valuation, market research, and property intelligence information
- Property address, property details, estimated value inputs, investment assumptions, tax, insurance, HOA, repair, rent, school, walkability, flood, comparable property, and public research inputs you submit or that our tools generate.
- Valuation reports, AI-assisted outputs, email delivery status, PDF generation status, public web research results, geocoding results, and internal report logs used to deliver, troubleshoot, and improve valuation tools.
2.8 Billing, payment, and subscription information
- Billing name, billing address, plan, invoice records, subscription identifiers, customer identifiers, payment status, transaction confirmations, failed-payment notices, chargeback records, tax and accounting records, and processor-provided payment metadata.
- Payment card or bank details are handled by payment processors where available. AvailableMax generally receives limited payment status and billing metadata rather than full card numbers.
2.9 Security, authentication, and policy acceptance records
- Login activity, IP address, browser or device information, user agent hash, trusted device records, email verification status, OTP or verification attempt metadata, rate-limit signals, suspicious activity indicators, and security logs.
- Terms of Use acceptance records and policy notice records, including version, URL, timestamp, source, IP address, and browser or device metadata used for account administration, audit, security, and dispute handling.
2.10 Cookies, pixels, and technical information
- Cookies, pixels, local storage, SDKs, analytics identifiers, advertising identifiers, session identifiers, device identifiers, browser type, operating system, referring URL, crash data, performance data, and similar technical information.
- Email delivery, open, click, bounce, unsubscribe, spam complaint, and suppression data where email tools or message providers support those functions.
2.11 Sensitive information and consumer-reporting data
Some workflows may involve sensitive personal information, such as government identification, identity documents, precise location if enabled, financial information, signature records, or information in uploaded files. If tenant screening, background checks, income verification, or consumer reports are offered, those services may involve additional information and may be subject to separate notices, authorizations, and third-party terms.
3. Sources of Information
We may collect information from:
- you directly, such as when you create an account, submit a listing, send a message, request a valuation, upload a document, sign a contract, or contact support;
- your device, browser, app, or network when you use the services;
- agents, agencies, developers, landlords, property managers, owners, advertisers, partners, counterparties, guests, team members, or organization administrators who use AvailableMax workflows;
- MLS, IDX, public records, government sources, property data providers, mapping or geocoding providers, analytics providers, advertising partners, payment processors, email providers, communication tools, identity or verification providers, and other service providers;
- third-party sign-in or integration providers, if you choose to connect or authenticate through them.
4. How We Use Information
We use personal information for purposes that include:
- providing, operating, maintaining, and improving AvailableMax services;
- creating, verifying, administering, supporting, and securing accounts;
- displaying listings, professional profiles, projects, search results, favorites, saved searches, dashboard data, and mobile app features;
- routing inquiries, leads, messages, support requests, contract invitations, and workflow notifications;
- processing subscriptions, invoices, billing, payments, renewals, cancellations, failed payments, refunds where applicable, and related finance records;
- generating valuation reports, property research, market insights, AI-assisted outputs, and related email or PDF deliverables;
- supporting contracts, documents, identity verification, e-signature workflows, audit trails, approvals, and recordkeeping;
- sending account, security, verification, transactional, policy, service, support, billing, listing, and marketing communications as permitted by law and your preferences;
- measuring performance, diagnosing issues, preventing fraud, enforcing limits, improving usability, and developing features;
- protecting the rights, safety, property, and integrity of AvailableMax, users, the public, and third parties;
- complying with applicable laws, industry rules, MLS or data-provider obligations, tax and accounting requirements, and valid requests from appropriate authorities;
- enforcing our Terms of Use, platform policies, agreements, subscriptions, and account rules.
7. Valuation, AI, and Property Research
AvailableMax may provide valuation, market analysis, property intelligence, automated workflows, AI-assisted drafting, and public research tools. These tools may process user-provided inputs, property data, public records, comparable-property information, geocoding results, web research, data-provider information, algorithms, and model outputs.
Do not submit sensitive personal information into valuation, AI, or research tools unless the workflow specifically requests it and you have authority to provide it. AI-assisted outputs and valuation reports may be incomplete, outdated, or inaccurate and should be reviewed before use.
We may use third-party technology providers to process valuation or AI-related requests. We may keep related inputs, outputs, email status, PDF status, and report logs to deliver the requested service, troubleshoot issues, improve tools, maintain records, and support account or business workflows.
8. Contracts, Documents, and E-Signatures
When you use AvailableMax contract, document, e-signature, approval, identity, guest access, or attachment workflows, we may process contract content, parties, counterparties, reviewers, comments, attachments, identity documents, signature records, timestamps, IP addresses, verification codes, delivery records, return records, and audit trail information.
We use this information to create and manage workflows, verify participants, deliver documents, record actions, maintain audit trails, support approvals or rejections, troubleshoot errors, enforce access controls, and preserve records where appropriate.
If you upload documents, identity materials, financial records, signatures, or third-party personal information, you are responsible for having the right to submit that information and for ensuring it is accurate, necessary, and appropriate for the workflow.
9. Payments and Billing
If you purchase a plan, subscription, advertising product, paid feature, or other service, we and our payment processors may process billing details, payment status, invoice records, subscription identifiers, customer identifiers, failed-payment records, chargeback records, tax information, and related account records.
We use payment and billing information to process transactions, manage subscriptions, send invoices and receipts, provide paid services, handle failed payments, prevent fraud, keep accounting records, resolve disputes, and administer account access or service limits.
10. Communications and Email
AvailableMax may send account, security, verification, transactional, support, billing, service, listing, policy, and marketing communications by email, SMS, phone, dashboard message, in-app notice, or other available channels. Transactional or security messages may still be sent even if you opt out of marketing messages.
Email delivery providers may process recipient names, email addresses, template data, delivery events, bounces, opens, clicks, spam complaints, unsubscribes, suppressions, and related metadata. Professional users and organizations may also receive lead, CRM, contract, billing, or workflow notifications through AvailableMax tools.
You can unsubscribe from marketing emails using the unsubscribe link in the message where available. For SMS programs, reply STOP where supported. Opt-out requests may not stop non-marketing messages needed for accounts, security, transactions, or services.
11. Mobile App, Dashboards, and APIs
Mobile app, dashboard, and API features may process login tokens, session data, favorites, saved searches, property views, professional profiles, lead submissions, device or browser metadata, request logs, rate-limit signals, and technical identifiers. Some dashboard tools may sync account, organization, membership, listing, CRM, contract, finance, or profile data between AvailableMax systems and subdomains.
API keys, bearer tokens, trusted-device records, OTP records, and other authentication information are used to protect access, reduce abuse, troubleshoot issues, and maintain service reliability. If you use an organization, agency, brokerage, developer, or team workspace, your administrators may be able to access certain account, activity, lead, listing, contract, and billing information associated with that workspace.
12. Listings, Profiles, and Public Content
Information you choose to publish or submit for publication, such as listings, property descriptions, images, videos, professional profiles, agency pages, developer pages, reviews, testimonials, comments, project information, and marketing content, may be visible to the public, indexed by search engines, distributed through platform features, or shared with partners as part of the service.
Do not publish personal information, confidential information, identity documents, private contact details, financial data, or third-party information unless you have the right to do so and understand that published content may be copied, indexed, saved, or viewed by others.
13. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide services, maintain accounts, keep business records, comply with obligations, resolve disputes, enforce terms, prevent fraud, protect security, and support audit or operational needs.
- Account and profile records: generally retained while the account is active and for a reasonable period after closure or inactivity.
- Listings, profiles, media, and published content: retained while active and for a reasonable period afterward for audit, data integrity, dispute, compliance, and operational needs.
- Leads, CRM, messages, and support records: retained as needed to support business workflows, customer service, dispute handling, and platform integrity.
- Contract, signature, identity, and document workflow records: retained as needed for the workflow, audit trails, recordkeeping, dispute handling, compliance, and business needs.
- Billing, invoice, payment, tax, and accounting records: retained as needed for accounting, tax, fraud prevention, chargeback, and financial recordkeeping purposes.
- Security, login, trusted-device, OTP, rate-limit, and policy acceptance records: retained as needed for security, account protection, audit, enforcement, and dispute resolution.
- Valuation, AI, report, and research records: retained as needed to deliver reports, support users, troubleshoot, improve tools, and maintain business records.
- Backups and logs: may persist for a limited period after deletion from active systems until overwritten or removed through normal retention cycles.
When information is no longer needed, we may delete it, de-identify it, aggregate it, restrict access to it, or retain it where permitted or required.
14. Security
AvailableMax uses administrative, technical, and organizational safeguards designed to protect personal information. These may include HTTPS/TLS, access controls, role-based permissions, authentication checks, OTP or email verification, trusted-device controls, rate limits, monitoring, logs, hashed device or user-agent signals, and other measures appropriate to the service.
No website, app, network, database, email system, or electronic storage method is perfectly secure. You are responsible for keeping your login credentials confidential, using a strong password, protecting your devices, and notifying us promptly if you believe your account or information has been compromised.
15. Your Choices
- Account information: you may update certain account or profile information through your account or by contacting us.
- Marketing emails: use the unsubscribe link in marketing emails where available or contact us.
- SMS messages: reply STOP where supported for promotional text programs.
- Cookies: use browser settings, device settings, platform controls, or available opt-out tools to manage cookies and tracking.
- Location: use your device or browser settings to disable precise location access.
- Public content: review information before posting. Some previously public information may remain in search engines, caches, backups, records, or third-party copies outside our control.

To exercise these rights, email privacy@availablemax.com with the email address associated with your account and a clear description of your request. We may need to verify your identity before responding. If an authorized agent submits a request for you, we may require proof of authorization and may ask you to verify your identity directly.
We will respond within the timeframe required by applicable law. If we deny a request in whole or in part, we will explain the reason where required and provide appeal instructions where applicable.

- Identifiers: name, email, phone, username, account identifiers, IP address, device identifiers, and similar identifiers.

17.2 Sale, sharing, targeted advertising, and sensitive information
We do not sell personal information for money. We may use or disclose identifiers, internet or network activity, device information, cookie data, and inferences with advertising or analytics partners in ways that may be considered a “sale,” “sharing,” or “targeted advertising” under certain state laws. You may request to opt out by emailing privacy@availablemax.com with the subject “Do Not Sell or Share Request.”
We use sensitive personal information for purposes such as account security, authentication, service delivery, contract workflows, payment and billing support, fraud prevention, safety, compliance, and other purposes permitted by applicable law. We do not use sensitive personal information to infer characteristics unrelated to providing or securing the services unless permitted by law or with appropriate consent.
17.3 Non-discrimination
We will not unlawfully discriminate against you for exercising privacy rights. However, some features may require certain information to function. If you ask us to delete or stop using information needed for a service, we may be unable to provide that service.
18. Children’s Privacy
AvailableMax services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that a child under 13 provided personal information, we will take reasonable steps to delete it.
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account or use AvailableMax in your own name.
19. U.S. Processing and International Use
AvailableMax is based in the United States, and our services are designed primarily for U.S. real estate activity. If you access AvailableMax from outside the United States, your information may be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your location.
20. Third-Party Services
AvailableMax may link to, embed, or integrate with third-party services, including payment processors, map providers, analytics tools, advertising networks, social media platforms, MLS or data providers, email providers, communication tools, identity or verification services, contract or document tools, AI providers, public-data providers, and partner websites.
Third-party services may collect information directly from you or receive information from us as described in this Policy. Their privacy practices are governed by their own policies and agreements, not this Privacy Policy.
21. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our services, technology, operations, privacy practices, or applicable requirements. When we update the Policy, we will revise the “Last Updated” date above. If changes are material, we may provide additional notice, such as by email, dashboard notice, in-product banner, or other reasonable method.
Your continued use of AvailableMax after an updated Privacy Policy is posted means you acknowledge the updated notice.
